These Terms of Use (hereinafter – the “Terms”) govern the use of the Phage.energy website and SaaS platform (hereinafter – the “Service,” “Phage,” “We”). By using the Service or creating an account, You agree to these Terms.

1. Definitions and Subject

1.1. Phage.energy (hereinafter – the “Service,” “Platform,” “Phage”) is a cloud-based platform (Software-as-a-Service, SaaS) that provides monitoring, analytics, forecasting, and optimization of energy assets, including battery energy storage systems (BESS), solar and wind power plants, and integrated energy systems.

1.2. The Service employs intelligent algorithms based on machine learning (ML) and artificial intelligence (AI) that allow users to:

  • forecast energy production, consumption, and balance;
  • optimize BESS charge/discharge cycles to increase profitability;
  • analyze asset behavior in real time;
  • automate participation in energy and balancing markets.

1.3. Phage.energy operates as an online service accessible via a web interface or software API and is provided to users for commercial or research purposes, depending on the selected pricing plan or agreement.

1.4. The Platform consists of several logical components, including:

  • Phage Core – core services for accounting, reporting, visualization, and asset management;
  • Phage Predictive AI – proprietary forecasting, optimization, and analytics modules owned by Phage Technologies OÜ;
  • Phage Open Source Modules – open-source modules distributed under the MIT License that may be used to extend functionality;
  • Phage API – a set of interfaces for integration with users’ other systems.

1.5. The subject of these Terms is to define the rules for using the Phage.energy website and platform, the procedure for service provision, the use of intellectual components, limitations of liability, data-processing rules, and dispute-resolution procedures between Phage Technologies OÜ and users.

1.6. All features, services, updates, modules, or additional products provided by Phage within the platform are governed by these Terms unless explicitly stated otherwise in a separate agreement or license.

1.7. User – any natural or legal person who:

  1. gains access to the Phage.energy platform;
  2. registers an account; or
  3. uses the platform’s functionality via the web interface, API, or other integrations.

1.8. Phage Technologies OÜ – the legal entity holding all intellectual property rights to Phage.energy’s proprietary modules, trademarks, user interface, algorithms, and analytical models, and acting as the contracting party governing the use of the Service.

2. Acceptance of Terms and Amendments

2.1. The use of the Phage.energy website or any platform services constitutes full and unconditional acceptance of these Terms by the user. If the user disagrees with any provision, they must refrain from using the Service.

2.2. Registration of an account, commencement of service use, integration via API, or continued access after updates to the Terms shall be considered confirmation that the user has read and fully agrees with the current version of the Terms.

2.3. Phage Technologies OÜ reserves the right to periodically amend or update these Terms, including by publishing a new version on the Phage.energy website. All changes take effect upon publication unless explicitly stated otherwise.

2.4. The user is solely responsible for reviewing the current version of the Terms. Continued use of the platform after amendments constitutes unconditional acceptance of the updated provisions.

2.5. Phage Technologies OÜ may send notifications about changes to the Terms or related documents (such as the Privacy Policy or pricing plans) by email or through the user interface. However, the absence of such notification does not release the user from the obligation to comply with published updates.

2.6. If any provision of the Terms is found invalid or contrary to applicable law, this does not affect the validity of the remaining provisions, which remain binding for both parties.

2.7. In the event that a separate agreement (license, commercial, or partnership contract) is concluded between the parties, the provisions of such agreement prevail over these Terms in matters that they both regulate.

3. Access to the Service and Accounts

3.1. Access to the Phage.energy platform is provided to users through a web interface or software interface (API) after registration of an account or the conclusion of a relevant agreement.

3.2. Account registration is carried out by the user independently by completing an electronic form or through access channels provided by Phage. The user undertakes to provide accurate, up-to-date, and complete information during registration and to promptly update it in case of any changes.

3.3. Each account is personal. The user is not entitled to transfer their account credentials (login, password, API keys, or access tokens) to third parties without the written consent of Phage Technologies OÜ. All actions performed through the user’s account are deemed to be performed by the user.

3.4. The user bears full responsibility for maintaining the confidentiality of their account credentials. In the event of suspected unauthorized access, the user must immediately notify Phage Technologies OÜ by email or through the support service.

3.5. Phage Technologies OÜ reserves the right to temporarily restrict or suspend the user’s access to the Service in the following cases:

  • violation of these Terms or applicable law;
  • detection of technical or security risks;
  • performance of planned or unscheduled maintenance work;
  • non-payment for services or exceeding limits established by the pricing plan.

3.6. The number of accounts, access levels, user rights, and available functionality are determined by the relevant pricing plan, license agreement, or commercial arrangement.

3.7. Phage Technologies OÜ may implement additional authentication, access-control, and security measures (including two-factor authentication, IP filtering, digital certificates, etc.), which are mandatory for users when necessary to protect data and ensure stable platform operation.

3.8. The user agrees that Phage has the right to maintain event logs, monitor activity, collect technical statistics, and use metadata within the scope of its Privacy Policy, solely for purposes of security, resource accounting, and Service improvement.

3.9. In case of contract termination or account deletion, the user loses access to the platform and all related services. The retention or transfer of user data after access termination is carried out only within the limits defined by the Privacy Policy or the agreement between the parties.

4. Scope and limitations of use

4.1. The Phage.energy Service is intended for professional use in monitoring, analytics, forecasting, and optimization of energy assets, as well as participation in relevant market and technical processes. The Service may only be used within its functional capabilities and in compliance with applicable law.

4.2. The user may use the Phage.energy platform for their own needs or in the interests of their organization in accordance with the selected pricing plan or concluded agreement. Any other use of the Service – including granting access, reselling, or using it for the benefit of third parties without the consent of Phage Technologies OÜ – is prohibited.

4.3. Any unauthorized interference with the operation of the Service is prohibited, including but not limited to:

  • attempts to gain unauthorized access to systems, data, or other users’ accounts;
  • use of scripts, bots, or automated systems to interact with the platform without using the official API;
  • modification of the source code, database structure, or operational algorithms of the Service;
  • decompilation, reverse engineering, or creation of derivative products based on components of Phage.energy.

4.4. The user is prohibited from:

  • copying, modifying, publishing, transferring, distributing, or reproducing any part of the Service or its content without written permission from Phage Technologies OÜ;
  • using the Service in a manner that could damage the reputation, operation, or security of Phage or third parties;
  • using the platform in ways that violate intellectual property rights, privacy rights, or cybersecurity laws;
  • providing false, inaccurate, or manipulative data intended to influence forecasting or analytical algorithms.

4.5. The user acknowledges that Phage.energy may limit or adjust the scope of available functionality depending on the pricing plan, volume of processed data, technical parameters, or system resource limitations.

4.6. Phage Technologies OÜ reserves the right to temporarily or permanently suspend the operation of certain modules or features of the Service when necessary for updates, maintenance, security mitigation, quality improvement, or other justified reasons.

4.7. The user agrees that the use of Phage.energy analytical, predictive, and optimization tools is at their own risk. The platform provides analytical recommendations and forecast results that do not constitute a guarantee of economic effect, profitability, or fitness for any particular purpose.

4.8. Phage Technologies OÜ reserves the right to establish additional technical and legal usage restrictions, including limits on API requests, data-refresh frequency, number of users, or integrated assets. Users will be notified of such restrictions via the website or platform notification system.

4.9. Violation of any restrictions listed in this section may result in immediate termination of access to the Service without refund of subscription fees or other payments, as well as potential liability under applicable law and the relevant agreement.

5. Open and сommercial сomponents, Intellectual Property

5.1. The Phage.energy platform consists of open-source and commercial components that together ensure its full functionality. The use of each type of component is governed by the relevant licensing terms specified in this section and in separate agreements or policies.

5.2. The open components of the Phage.energy platform are distributed under open licenses, including the MIT License. These components may include basic libraries, parts of the user interface, documentation, templates, and general software modules that do not contain proprietary algorithms or artificial intelligence models.

5.3. The commercial components of Phage.energy include proprietary modules developed and owned by Phage Technologies OÜ. These include:

  • machine learning and artificial intelligence (ML/AI) modules used for forecasting, optimization, and analytics;
  • software libraries, models, algorithms, training datasets, and the results of their training;
  • integrated solutions for predictive control, intelligent data analysis, and participation in energy markets.

5.4. The user is granted access to and the right to use the commercial components solely under the license issued by Phage Technologies OÜ. This license is non-exclusive, non-transferable, time-limited, and valid only for the purposes defined in the agreement or pricing plan.

5.5. Any copying, modification, decompilation, distribution, or creation of derivative works based on the commercial components of Phage.energy is prohibited without the written permission of Phage Technologies OÜ.

5.6. All intellectual property rights to the Phage.energy platform – including but not limited to its source code, system architecture, algorithms, data models, user interface design, technical documentation, trademarks, logos, and the domain name phage.energy – belong to Phage Technologies OÜ or its licensors.

5.7. Registration or use of an account, as well as access to any functionality, does not imply the transfer of ownership rights or any exclusive intellectual property rights. All rights not expressly granted to the user remain with Phage Technologies OÜ.

5.8. The user may use the open components of the platform for their own purposes only within the limits of the respective open licenses. In doing so, the user must preserve all copyright notices, trademarks, and references to Phage Technologies OÜ in their original form.

5.9. In the event of a violation of intellectual property rights, Phage Technologies OÜ has the right to demand the immediate cessation of the unlawful use and to claim damages in accordance with applicable law and the agreement.

5.10. The use of names, logos, or visual elements of Phage without written consent from the company is prohibited, except in cases explicitly permitted by the license terms or partnership agreement.

5.11. If the user creates any feedback, comments, suggestions, modifications, or other materials related to the operation of the Phage.energy platform, they grant Phage Technologies OÜ a non-exclusive, perpetual, and unrestricted license to use such materials free of charge for product improvement.

5.12. Phage Technologies OÜ reserves the right to publish information about the use of the platform’s open components by third parties, provided that such publication does not disclose confidential user data.

6. Licenses and Payment

6.1. Access to the Phage.energy Service is provided on the basis of licensing terms or a commercial agreement between the user and Phage Technologies OÜ. Such a license grants the user the right to use the Service for a specified period and within the functional limits established by the agreement.

6.2. The license granted to the user is non-exclusive, limited, non-transferable, and does not imply the transfer of ownership or any intellectual property rights related to Phage.energy software or assets.

6.3. The scope of user rights, license duration, access cost, and payment procedure are determined in the respective pricing plan or commercial agreement. Certain functions or modules may be subject to a separate commercial license.

6.4. Use of a free or trial version (if provided) is governed by a limited license that may be revoked by Phage Technologies OÜ at any time without prior notice.

6.5. All payments for the use of the Service are made in the currency specified in the pricing plan or agreement, in accordance with issued invoices or platform conditions. The user must make payments on time and in full.

6.6. Phage Technologies OÜ reserves the right to change the cost of tariffs, plan structures, or payment terms by publishing updated information on the official website or through the platform’s notification system. New terms take effect upon publication or within the time specified in the notice.

6.7. In case of non-payment or late payment, Phage Technologies OÜ has the right to temporarily suspend or restrict user access to the Service and to charge penalties or late fees if stipulated by the agreement.

6.8. Payments are non-refundable unless otherwise explicitly provided by the agreement or applicable law. The user acknowledges that access to the platform or use of any part thereof constitutes the beginning of service provision.

6.9. If the license or agreement provides for automatic renewal, payment for the next period will be charged automatically using the previously selected payment method, unless the user opts out before the start of the new billing period.

6.10. Phage Technologies OÜ may engage payment partners or processing systems to accept payments. The user agrees that such payments may be subject to additional third-party terms, which they must review before completing the transaction.

6.11. In case of billing errors or duplicate payments, the user has the right to contact Phage Technologies OÜ support for reconciliation and resolution.

6.12. Any violation of license terms, including exceeding permitted usage limits, attempting to bypass access control systems, or unauthorized copying of components, is considered a material breach and may result in immediate license termination without reimbursement of paid fees.

6.13. Phage Technologies OÜ has the right to charge interest on overdue payments and recover additional expenses associated with debt collection if permitted by law.

6.14. All taxes, commissions, and mandatory fees arising from the use of the Service are paid by the user unless otherwise specified in the agreement or invoice.

6.15. Phage Technologies OÜ reserves the right to suspend or terminate a license if user violations or security noncompliance are detected, notifying the user by email or other available means.

7. Support, updates, and service level

7.1. Phage Technologies OÜ provides technical support to users of the Phage.energy platform in accordance with the standard service level agreement (SLA) or individual terms defined in the agreement.

7.2. Standard support includes:

  • consultations on using the platform, its functionality, and configuration;
  • receiving and processing user requests regarding technical errors or system failures;
  • providing recommendations for effective use of the Service’s features;
  • monitoring the status of core services and responding to critical incidents.

7.3. Requests to the support service may be submitted by email, through the feedback form on the website, or via other channels defined by Phage Technologies OÜ. Response time depends on the level of issue severity and the scope of support provided under the pricing plan or agreement.

7.4. The standard working hours of the support service are business days from 9:00 to 18:00, excluding official weekends and public holidays. Users with extended licenses may be provided with an individual service mode (for example, 24/7).

7.5. Phage Technologies OÜ regularly updates the Phage.energy platform to improve functionality, fix errors, enhance security, and optimize performance. Updates may be implemented without prior user approval, provided they do not reduce availability or materially alter usage conditions.

7.6. The user agrees that short service interruptions may occur during updates or maintenance. Phage Technologies OÜ strives to minimize such interruptions and, where possible, informs users in advance of scheduled maintenance.

7.7. In the event of unforeseen technical incidents, cyberattacks, software malfunctions, or limited service availability, Phage Technologies OÜ will take all reasonable measures to restore normal system operation as quickly as possible.

7.8. The target platform availability level is at least 99% per calendar year, excluding planned maintenance, force majeure events, or issues caused by third parties or the user.

7.9. Phage Technologies OÜ is not responsible for unavailability or restricted access to the Service caused by internet provider failures, user equipment issues, third-party services, or cloud providers used by the user.

7.10. Phage Technologies OÜ may temporarily suspend specific modules or functions for updates, technical checks, or integrations if required to maintain stability, security, or performance.

7.11. The user must regularly update their software, browsers, API clients, or other tools interacting with Phage.energy to ensure compatibility with the current version of the Service.

7.12. Unless otherwise specified in the agreement, Phage Technologies OÜ does not guarantee the provision of custom modifications, improvements, or integrations upon user request. Such services may be provided separately for an additional fee.

7.13. The user acknowledges that any changes to the structure, interface, or operation of the Phage.energy platform, including updates to design, functionality, or algorithms, are at the sole discretion of Phage Technologies OÜ and do not require user approval.

7.14. Phage Technologies OÜ may provide security updates affecting authentication policies, access management, or data storage if necessary to comply with legal or information security standards.

8. Confidentiality and Data Processing

8.1. Phage Technologies OÜ pays particular attention to the protection of confidential information and users’ personal data. All actions related to the collection, processing, storage, and transfer of data are carried out in accordance with applicable European Union legislation, including the General Data Protection Regulation (GDPR), as well as the company’s internal policies.

8.2. The term “personal data” means any information that can directly or indirectly identify an individual user of the Phage.energy platform. Such information may include name, email address, phone number, IP address, payment data, or any other information provided by the user during registration or use of the Service.

8.3. The term “confidential information” means any technical, commercial, analytical, energy-related, or other data that the user transmits or generates while working with the platform, as well as any information about the structure, algorithms, architecture, or operational principles of the Service that is not publicly available.

8.4. Phage Technologies OÜ undertakes to ensure an appropriate level of protection for users’ personal and commercial data by using modern technical, organizational, and legal measures, including encryption, access control, operation audits, and security monitoring.

8.5. User data is used exclusively for the following purposes:

  • providing access to the functionality of the Phage.energy platform;
  • ensuring technical support and improving service quality;
  • conducting analytics, monitoring, product development, and algorithm optimization;
  • fulfilling contractual obligations, including invoicing and payment processing;
  • complying with legal requirements, including financial monitoring and data security.

8.6. Phage Technologies OÜ may transfer personal data to third parties only in the following cases:

  • when necessary for the performance of the agreement (for example, to payment processors or hosting providers);
  • when the user has given prior consent for such transfer;
  • when required by applicable law or a competent authority’s decision.

8.7. All third parties who gain access to user data must comply with the confidentiality and security principles set out by the GDPR and Phage Technologies OÜ’s privacy policy.

8.8. Phage Technologies OÜ does not sell, lease, or commercially distribute users’ personal or confidential data. All collected data is used solely for lawful and contractual purposes.

8.9. The user has the right at any time to:

  • access their personal data processed by the company;
  • request correction of inaccurate or outdated data;
  • request deletion of their personal data (“right to be forgotten”) if it is no longer necessary for contractual purposes;
  • restrict or withdraw consent to data processing.

8.10. To exercise these rights, the user may contact Phage Technologies OÜ via email at legal@aggregator.energy or through the contact form on the website. Requests are reviewed within a reasonable period, but not later than 30 days from receipt.

8.11. Phage Technologies OÜ stores users’ personal data only for as long as necessary to achieve the processing purposes or comply with legal obligations. After this period, the data is securely deleted or anonymized.

8.12. The user agrees not to disclose information about the operation of the Phage.energy platform, nor to copy or transmit interface elements, database architecture, source code, analytical algorithms, or other elements that may contain the trade secrets of Phage Technologies OÜ.

8.13. Phage Technologies OÜ may store and use anonymized user data for statistical, scientific, or analytical purposes, provided such data cannot identify a specific individual.

8.14. In the event of a data breach, unauthorized access, or compromise of personal data security, Phage Technologies OÜ will immediately take steps to localize the incident, notify the relevant supervisory authorities, and inform affected users.

8.15. All issues related to personal data processing, additional privacy policies, cookies, or the use of third-party services are regulated by the Phage.energy Privacy Policy, which forms an integral part of these Terms.

9. Disclaimer of warranties and limitation of liability

9.1. The Phage.energy Service is provided to users “as is,” without any express or implied warranties regarding error-free operation, compliance with user expectations, uninterrupted functionality, or suitability for any particular purpose.

9.2. Phage Technologies OÜ does not guarantee that the platform will operate continuously, without errors, or be completely protected from external interference, cyberattacks, technical failures, or other events that may affect system availability or stability.

9.3. Phage Technologies OÜ is not liable for any direct or indirect damages, data loss, decreased performance, loss of profits, loss of business reputation, or other consequences resulting from:

  • software malfunctions;
  • improper or unauthorized use of the platform;
  • failures or errors of third-party services, integrations, cloud providers, or payment systems;
  • user actions that compromise security or cause data loss;
  • failure by the user to follow recommendations for proper Service use.

9.4. The analytical, forecasting, and optimization results provided by Phage.energy are probabilistic in nature and do not constitute financial or investment advice. The user makes decisions based on such data at their own risk.

9.5. Phage Technologies OÜ is not responsible for actions by users or third parties that use the platform for illegal purposes or in violation of intellectual property rights, nor for the accuracy of data entered by users.

9.6. In the event of any claims from third parties arising from the use of the Service, the user undertakes to resolve such claims independently and to compensate Phage Technologies OÜ for any losses caused by such actions.

9.7. The total liability of Phage Technologies OÜ for any damages or losses arising from the use of the Service shall in no case exceed the total amount of payments made by the user during the three calendar months preceding the claim.

9.8. None of the provisions of these Terms limit the liability of Phage Technologies OÜ in cases where such limitation is expressly prohibited by applicable law.

9.9. Phage Technologies OÜ is not liable for delays or non-performance caused by force majeure circumstances, including war, natural disasters, accidents, strikes, cyberattacks, actions of governmental authorities, or disruptions in global telecommunications networks.

9.10. The user acknowledges that Phage.energy is a tool for data processing, analytics, and forecasting, and that final decisions regarding energy asset management, transaction execution, or operational activities are made solely by the user.

9.11. When using open-source or third-party components, Phage Technologies OÜ bears no responsibility for their stability, security, or compliance with user technical requirements. The user assumes full responsibility for integrating such components.

9.12. The user agrees that the use of the Service is at their own risk, and Phage Technologies OÜ does not guarantee the achievement of any specific economic, technical, or commercial results.

10. Termination of access

10.1. Phage Technologies OÜ has the right to temporarily restrict or completely terminate a user’s access to the Phage.energy platform in case of violation of these Terms, the license agreement, or applicable law.

10.2. User access may be suspended or limited in the following cases:

  • failure to fulfill financial obligations, including non-payment for the Service within the established period;
  • attempts to gain unauthorized access to the system or actions that compromise platform security;
  • detection of unauthorized use of the software, including transferring access to third parties without permission;
  • use of the Service for unlawful purposes or in a manner that may harm Phage Technologies OÜ or other users;
  • violation of confidentiality terms, copyright, or the commercial license.

10.3. Phage Technologies OÜ shall notify the user of the suspension or termination of access by email or other available means, if technically possible. In cases of serious or repeated violations, access may be terminated without prior notice.

10.4. In the case of temporary suspension, Phage Technologies OÜ may restore access after the causes of the violation have been remedied and the user has confirmed compliance with the necessary conditions (for example, payment of debts or cessation of unauthorized activities).

10.5. The user may independently terminate the use of the Service at any time by deleting their account or submitting a corresponding request to Phage Technologies OÜ support. Termination of use does not release the user from obligations that arose prior to such termination.

10.6. After access termination or account deletion:

  • all related rights to use the Service shall expire;
  • Phage Technologies OÜ may delete or anonymize user data after the retention periods specified in the privacy policy;
  • access restoration is possible only by creating a new account or signing a new agreement.

10.7. Phage Technologies OÜ reserves the right to unilaterally discontinue access to the platform or specific modules in case of business termination, liquidation, or reorganization of the company, notifying users in advance through official communication channels.

10.8. All licenses, usage rights, active subscriptions, or agreements are deemed terminated upon access discontinuation unless otherwise provided by specific contractual terms.

10.9. If access termination is initiated by Phage Technologies OÜ due to a violation of the Terms, any amounts paid by the user are non-refundable. If termination occurs due to technical or organizational reasons beyond the user’s control, the company may offer proportional compensation or extend access for an equivalent period.

10.10. Phage Technologies OÜ is not responsible for user data or content loss following access termination if the user did not back up or export the data available in their account in a timely manner.

11. Force Majeure

11.1. The parties are released from liability for full or partial non-performance of their obligations under these Terms if such non-performance results from force majeure circumstances that arose after the conclusion of the agreement or the start of Service use and directly affected the ability to perform those obligations.

11.2. Force majeure circumstances include events that the parties could not have foreseen or prevented by reasonable means, such as:

  • war, military actions, invasion, blockade, terrorism, riots, or strikes;
  • natural disasters (earthquakes, floods, fires, hurricanes, storms, or other natural catastrophes);
  • accidents, industrial or technological disasters, explosions, or infrastructure failures;
  • epidemics, pandemics, emergencies, or quarantine measures restricting business activity;
  • cyberattacks, data center failures, telecommunication or global internet disruptions;
  • actions or inaction of government authorities or the adoption of regulations preventing performance.

11.3. The party affected by force majeure must notify the other party in writing (by email or through the platform’s notification system) within 10 calendar days of the occurrence, indicating the nature of the event, its expected consequences, and its duration.

11.4. Failure to provide or delay in providing such notification deprives the party of the right to rely on force majeure as grounds for exemption from liability.

11.5. During the period of force majeure, the performance of obligations under these Terms is suspended. The time for performance is extended by the duration of such circumstances and the time necessary to eliminate their consequences.

11.6. If force majeure circumstances continue for more than 60 consecutive calendar days and performance cannot be restored, either party has the right to terminate the agreement or discontinue Service use without mutual penalties or compensation.

11.7. Confirmation of the occurrence of force majeure may be provided by a document issued by the Chamber of Commerce or another competent authority of the country where the event occurred.

11.8. Phage Technologies OÜ is not responsible for delays, operational failures, or Service unavailability caused by factors beyond its control, including interference with internet providers, energy suppliers, data centers, or third-party platforms essential for Phage.energy operation.

11.9. The user agrees not to make any claims against Phage Technologies OÜ for non-performance or improper performance of obligations due to force majeure circumstances if the company has duly notified the user and taken all reasonable measures to minimize the consequences.

11.10. After the termination of force majeure circumstances, the parties must resume performance of their obligations as soon as possible or agree on a new procedure for their fulfillment.

12. Dispute Resolution and Governing Law

12.1. These Terms and all legal relations arising from the use of the Phage.energy platform are governed by the substantive law of Estonia, unless otherwise specified in a separate agreement between the user and Phage Technologies OÜ.

12.2. All disputes, disagreements, or claims arising between the user and Phage Technologies OÜ in connection with the execution, interpretation, or termination of these Terms shall, in the first instance, be resolved through negotiations and official correspondence between the parties.

12.3. If the parties fail to reach an agreement through negotiations within 30 calendar days from the date of receiving a written claim, the dispute shall be submitted to the competent court of Estonia, unless otherwise expressly provided by the agreement or an applicable international treaty.

12.4. Phage Technologies OÜ may, at its discretion, offer the user an alternative dispute resolution (ADR) method, including mediation or arbitration, if such an approach promotes faster and more effective settlement of disagreements.

12.5. All notifications, claims, and legal communications within the dispute resolution procedure must be submitted in writing by email or through another mutually agreed communication channel. Proof of delivery shall be deemed confirmation of email receipt or any other documented acknowledgment.
